Actually a couple.. I've been reading about registering a suppressor may be deemed unconstitutional if it passes. I guess law makers have 7 days or so to appeal. I was talking to a dealer this morning and he says its true but an appeal could take years. I asked if maybe I should wait on a purchase and that's when he said about the appeal time. What do you think? I know I probably left out a lot but hopefully you get my drift. My other question is... one dealer wants $45 to do the paperwork and $25 for fingerprints. Is this normal? The store I was at this morning charges $30 for everything.
 
This ruling only applies to members of GOA and residents of the 15 states that were part of the lawsuit. If you're not a GOA member or a resident of West Virginia, Idaho, Wyoming, North Dakota, Indiana, South Dakota, Kansas, Georgia, South Carolina, Oklahoma, Texas, Utah, Montana, Alaska or Louisiana the ruling doesn't apply to you.
GOA membership is only $25 a year and will cover new members as well as existing members in regard to the NFA ruling.
 
Put your right hand on a$$ waiting for the government to do something, you will most likely go thru life left handed. There is no way the government gives up a registration like the one they have without a fight. $30 for the paper work seems reasonable.
 
I just bought suppressor, my only fee is the transfer fee at my dealer. I bought mine through a Silencer Shop kiosk at my LGS.

From a letter from Silencer Shop the government has 7 days to appeal if not the ruling goes into effect in 14 more days.

The gist of the suit is that all the paperwork was to facilitate collecting the tax fee. Since the government dropped the tax fee the paperwork is irrelevant.

It seems it would be advantageous to drop the paperwork since they are no longer collecting the tax and let suppressors sell the same as firearms
 
From PA here and it didn't cost me anything. I don't know what "sprinkman" is talking about but you living in OK seem to be unlucky and will cost you a few shillings.

Ideally, yes, along with buying & selling willy nilly like stocks or scopes.

Should open up the used market and eliminate the Form 1 hoops you had to jump through, which should include any & all repairs or modifications of your current suppressors.

Are we still required to use form 4473?

Ok I'll sound like counter on that, from what I read Silencer shop was also enjoined into that. which means if so that means it would apply to dealer and customers of Silencer Shop as well, for a simple 4473 transfer IF. And that is a mighty big IF the DOJ doesn't file for appeal. Now I'm not saying @Sprinkman is wrong in what he states, as honestly this has not played out yet. We simply do not know and everyone one is rushing to spin it to meet their view or objective.

Silencer shop has filled my inbox with this so yeah.. even they won't go out on the limb. First hurdle will be the Aug 12th 2026 deadline. To see if they (DOJ) files. If not I guess the 4473 will apply and those enjoined into the case will be allowed to conduct business with simply the 4473.
(bear in mind the post "may 19th 1986" transfers that happened in the past with the FOPA of 86, even though ATF approved them they wound up in a special slot/ category. This could happen again)

Bill I would simply wait and see if I was to go that route. If DOJ was to file even as last as the 13th and the court accepted it. I would probably not wait for the appeal to clear as the win was long and drawn out because of the legal system itself. even if one was to wait until say the 13th and the response it crickets it would impose some confusion as to the way ATF /dealer would have to handle the situation. Now if your shop/dealer did a lay away program, yeah might be a good option.

Like everyone I'm simply waiting to see how this unfolds


as far as trashing the paperwork for my existing can if this was completely over turned. I personally would not do that I would definitely retain my copy. Just in case they (Dem's) get enough power to revisit this with a simple adding a $$ to the tax. Bear in mind this is ONLY winning based on the $$ if that is increased at any time we are back at square 1. Legal under the Congress power to levy a tax. And yeah they could impose that new tax at any time where no tax has been paid I could see the new tax rate being applied. Sure there most likely be a amnesty period which I'm pretty sure they (would) eat up 50% of the time before announcing the amnesty.
But I for one would keep all my paperwork on my existing items, especially if the Gov't "tosses" theirs.

One thing the guy at the shop said that if it was appealed, no telling how long that might take. Scheel's has the best deal and I don't go anywhere near that place on the week-ends. It's in the busiest mall in Tulsa. So I do have time to wait it out.

That my friend is a fact. And waiting past the 20th or so if appealed would in my opinion be a total waste. As the Supreme court doesn't have to hear the case. and can simply send it back to the lower court. Or leave it for consideration for a extended period of time, which the congress could assign a dollar value killing the argument. ( yeah I know I sound like doom and gloom. The win is frail, but is still a win, and might work or backfire in the long game).
 
I have never paid a transfer fee when ordering from Silencer Shop or Silencer Central. A friend knows somebody at the ATF and was told they do not intend to file an appeal. Hopefully that is true but I believe the DOJ can. We will see what happens next week.
