A 72-year-old grandmother from Texas was taken to jail after she was tasered by a police officer during a routine traffic stop.

Kathryn Winkfein was pulled over for speeding, but refused to sign the ticket and told the officer to take her to jail.

After she exited her vehicle, the officer shoved her, he said, to keep her out of traffic. When Winfein didn't cooperate, she was tasered.

Winkfein was not seriously injured and was taken to jail.

The officer, who is also a taser instructor, will face no charges for his actions because his boss says he did everything by the book.

Sgt. Major Gary Griffin - "My mother is 77. If she conducted herself in such a manner...don't argue with the police. Just don't."

Winkfein was charged with resisting arrest and has hired an attorney.

If you watched the video (On many TV stations) things went down pretty much as reported...she was pretty resistive....

Some comments were made about her age and size, but had the officer/deputy gotten any more physical with her, there could possibly been some broken bones in her...

Women that age are prone to Osteoporosis and prone to bone breakage without much effort.

I don't know about Texas, but in Arkansas police with Tasers look for any opportunity to use them. Sass the cops get tasered. Just the way it works now days.

Usually 72 years is long enough to thin the herd of idiots....but there is an exception to EVERY rule. This is a great example of the effectiveness of Pain Complience. I hope The Officer's batteries were fully charged!

It was old lady for cryin out loud.If it was any of you guys' grandma would you still feel the same way about it?I seriously doubt it.If you ever get the news that you grandmother has been tasered because she sassed a cop and you're response is "I hope he had the batteries fully charged!" I dont know what to tell ya.I'd have to assume your not a very nice person. /ubbthreads/images/graemlins/confused1.gif

That woman had every chance to just sign the ticket and be on her way. She didn't just sass the cop, she physically resisted arrest. I believe in Texas the law is if you don't sign the ticket you will go to jail. She refused to sign the ticket, so she knew what was comin. The video, which most of it wasn't posted, went on for around 10 min. While the officer was giving her every opportunity to put her hands behind her back. She had every opportunity to comply. She didn't. The officer tried to put her hands behind her back but she resisted. The officer could have used other techniques to put her into cuffs and it very well could have caused injuries to her. On a younger person, you would have seen the officer take the person to the ground and forcefully cuff the suspect. I think tasering was the lesser of the two. The end result was she was fine and little humiliated after going to the local news to talk about it and denying being abusive and resisting. Once she saw the video, she hasn't said anymore.

Being an officer, I do believe the taser is abused on occasion, but you have to look at it the other way. A lot of times to gain compliance the officer would deliver strikes or pressure point tactics which sometimes resulted in injuries to the officer and suspect. Not very often with the use of tasers is there injuries.

If it were me, when she said that she would sign the ticket halfway into it, I would have let her. But I do not know the policies and practices of that dept.

I can agree with that but that could have given her a heart attack though right?I mean she sat behind Jesus in the 2nd grade so she cant take a high voltage of electricity like a younger person can.I'd rather risk breakin her arm puttin her in hand cuffs instead of killin her on the spot. The fall could have hurt her really bad too so thats somethin else to think about.Im just sayin using a taser is a little over the top.If he was gonna do anything he should have squirted her with mase. Her eyes would have burned but theirs not a risk of her heart stoppin that way. /ubbthreads/images/graemlins/confused1.gif
But then again I was'nt there so I can't say what I would have done differently.I dont think I would have tazered her though.

Only thing that The Officer did wrong was, push the "lady" out of the traffic. The lady should of had someone else go to the Check Cashing place and buy her smokes & lottery scratch off tickets. Especially IF she CAN'T act like a decent Human Being. What do You expect out of this Officer....he is ONLY human. He approaches this truck, it could have a Cop Killer or a Preacher [He has to be ready for anything]. It turns out to be a wantabe lawyer who doesn't complie w/ the Officer directions. Even though it WASN'T pretty, The Officer resolved the conflict in the safest and quickest way.

And as far as My Granny, She is about as high strung, hard headed[WHO I LOVE GREATLY] as you get. In her 80 plus years on this planet, has NEVER had this problem!

To let You know, I'm NOT in Law Enforcement and no one in my Family is either. Nobody in there right mind likes to think about ANYTHING bad happening to ther Grndmother. But from what I observed on that video clip, The Officer's actions might of saved that Woman a lot of pain and injuries with his quick actions.

So in My opinion SHAME on that Lady for acting that way & putting that Officer in that position in the 1st place.

Also it ISN'T a major ordeal to be a Grandmother(another buzz word for the media to use...like assult rifle). It is Saturday Night, tonight....I'm sure there is thousands of new ones being made in back seats of cars all over. So the fact she is Parent of a parent, is not that big of a deal. BUT what is amazing, is she this age and SO STUPID! When you hear a Grandmother mentioned, You think VERY pleasent thoughts of Your Childhood (atleast I do), not some jerk risking her life along with an Officer's. Just to be non complient because she knows better.WHAT A JOKE!!!!

I see what your sayin.I agree she should'nt have been actin the way she was.But I still say using the taser on her might not have been the best thing to do.It could have turned out bad but luckily she did'nt get hurt. And best of all she's gonna think twice before being a jerk.

OKRattler.... All I can add to your comments is...

"You've apparently never been on the receiving end of a lawsuit for "Brutality" where someone was injured during an arrest."

Pepper spray in the eyes of an elderly person that may already have vision problems is just as dangerous to them in the long run...Broken bones on a young person is bad, but on an older person can be debilitating for the rest of their life...

Believe me,,, there is less long term risk to a person, even in poor health, from the tazer than other methods...

I agree with you Rattler, she was a little old broad that had attitude! He, the cop, could have easily killed her at that age. I think the cop could have handled the whole thing allot better. I didn't hear him talk to her in a calming manor, he went into super-cop and pushed, yelled and tasered her. The video is cut up and we have no idea what set the old girl off. I guess this clown missed the class on dealing with crotchety old people.

Most states, if you don't sign the ticket, no big deal, the cop dose you get a copy and you get a summons for court in the mail. This was a speeding ticket, minor traffic infraction turned into a mess by a cop that lacked skills in dealing with people. This seems to be a growing trend in law enforcement today. Face it, this kind of behavior is acceptable cause people are letting it become this way. When people get sick of "bully's with a badge" it will stop, until then it will keep getting out of hand. Maybe next time it will be your mom or grand mother then we will see what your stand will be.... SHE WAS NO THREAT to that big cop, so why use violence in a traffic stop? He was dead wrong and made the situation worse with his piss poor attitude and interaction with this little old lady.

It didn't look like the cop got out of hand,in this incident,IMO.My thoughts when I first saw this vid.was I hope it doesn't get physical, because he might break a her bones.Broken bones = big lawsuits. This is just a no win situation, sadly for the cop.If he would have pepper sprayed her,it still would of made the news.Broken bones, lawsuit, definitely. What if he had to struggle with her and they ended up in the road, and hit by a passing car and killed them both?I'm sure the man was strong enough to keep her off the road, but may would have had to use more force.More force = more injuries. If he would have thrown her to the ground and cuffed her,it still would have made the news. She was obviously combative. She also played the 'age card' right off the bat.Nice.Do you think this cop was profiling seniors?Probably not.Just because she can get a seniors discount on meals, doesn't mean she gets immunity from the law.I don't think the cop tasered her out of anger. With the attitude she had at the time,I don't think he could have reasoned with her any more. The cop gave her,her options, and told her the consequences. It was her decision on how it went down. She was the only person to blame for being tasered.I'm sure the ACLU will try to crucify the cop, with a all exspence paid trail. It's obvious the lady wasn't thinking very rationally. She was throwing a little toddler fit, dropping the 'F bomb' before she ever exited the car. When she broke free when the cop tried to handcuff her,I believe he had enough reason to tase her.Too bad for the cop. He's in a no win situation.I'm just happy it was a white woman. If she would have been black,Johnny Cochran wannabe's would be all over this case, and then it's Katy bar the door!

Old lady bought her ticket. Comply, or go to jail.

It kills me when joe citizen has the "right" to ignore repeated commands from a LEO. Only to be jerked around & or assaulted, by these self rightous law abiding people[insert contempt, here].

Probably a good thing I'm not or wasn't a LEO. As many "rightous citizens" would've hit the dirt or pavement /ubbthreads/images/graemlins/smile.gif. As I would've enjoyed assisting them to their self rightous goal.

Odds are this 'grandma' has had that attitude all her life, only, this time, it went on display across america. The cop did his job and did it well.

First, the Taser is not heartstopping. Many tests have been done with people with pacemakers and heart problems and no problems. My 67 yr old police chief took it with no problems. Most of the deaths that have occurred have been with people that were high on coke, meth,or some other narcotic. Trust me, the taser was less painfull than the possible consequences if he would have went "hands on". It's obvious to me Ricc 9 that you have a problem with police or the taser, or both. Educate yourself on the taser and see how injuries to both officers and suspects have lessened. Looking at the other thread you started about the guy who died from the taser. I hope you weren't basing your opinion on just that article. I can bet there were other major circumstances involving that. How many mentally unstable people have you dealt with? I have dealt with several ranging from quiet submissive one second then attacking you the next.

I think the biggest thing here is personal responsibility. So it's the police's fault she was speeding, refused commands, and resisted arrest. Remember all she had to do was sign the ticket? What is so hard about that? If she disagreed with it, go to court. Thats what it is there for. Since when is it ok to resist police commands? It is against the law in all states that I know of. If there is some disagreement, settle in court. The woman needs to own up. Say she screwed up.

Last thing, just about everybody I know would rather get tased than pepper sprayed anyday, including me. The pain of the taser last for 5 secs and done. The spray lasts for hours.

I've never been "tazed" myself. But many moons ago, one of my older Bro's, dared me to pee on an electric fence[weed cutter]. When I was 6 or 7yrs old. It is true, electricity can stop a beautiful arc instantly. At mid high arc.

Electricity = good, sort of.
Bro's = evil /ubbthreads/images/graemlins/smile.gif

KIRBY - to funny!! It seems that the vast majority of us who were kids and around electric fences learned our lessons well. I was coerced into going through a barbed wire fence where the center wire was on insulators. Aw go ahead my friend said - its not turned on. Yep, sure. Very exciting minute while I fought the wire, and then, chased my bud for a quarter mile with the intent of maiming him..

Sorta looked at him with slitted eyes from then on.

I think he wet his pants laughing at my 'city boy' dance in th fence.

Weed cutter? Thats a real big ouch!! I've got one of those around the orchard/garden and it brought a full grown black lab to its knees. I swore I saw smoke and fire on the end of his nose!

As if that wasn't enough. Some yrs later, when I was in eigth grade, we moved to a farm acrege. Bro[same evil brother] & I was checking out the landscape & out buildings. Well, I had to take a leak, so I walked behind the pump house. Behind the pump house was a fenceline with tall weeds. I was casually writing my name in the weeds. Then I felt the intial pulse[Hmm, seems I've felt this before], instantly followed by the large pulse.

Quickest way to stop a stream, no doubt. I'm surpised my bladder even works anymore, LOL!
