Hostess to Liquidate, Lay Off 18,500 After Crushing Union Fight

Failing to persuade striking employees to return to work, Hostess Brands disclosed plans on Friday to liquidate its assets and lay off most of its 18,500 workers, bringing the 82-year-old maker of Wonder Bread and Twinkies to the end of its line.

The painful decision to wind down the Irving, Texas.-based private company follows a nationwide strike that Hostess said severely constrained its operations.

Hostess said delivery of its products, which include Ding Dongs and CupCakes, will continue and its retail stores will keep their lights on for several days to sell already-baked products.

“We deeply regret the necessity of today’s decision, but we do not have the financial resources to weather an extended nationwide strike,” Hostess CEO Gregory Rayburn said in a statement.

As a result of the liquidation, Hostess said it will “move promptly” to lay off “most” of its 18,500 employees and focus on “selling its assets to the highest bidders.”

The company will now be forced to close its 33 bakeries, 565 distribution centers, 5,500 delivery routes and 570 bakery outlet stores throughout the U.S.

The Bakery, Confectionery, Tobacco Workers and Grain Millers International Union pushed back against the Rayburn blaming the liquidation on the unions.

“The truth is that Hostess workers and their Union have absolutely no responsibility for the failure of this company. That responsibility rests squarely on the shoulders of the company’s decision makers,” Frank Hurt, BCTGM International Union President, said in a separate statement released on Wednesday.

Founded in 1930, Hostess owns a slew of well-known brands, including Drakes, Dolly Madison, Twinkies, Ding Dongs, Ho Ho’s and Wonder.

It’s not clear what, if any, company or companies will step in to scoop up those brands, but it seems likely potential bidders will at least inquire.

Hostess said its lenders have agreed to provide the company with access to the $75 million financing facility to fund the sale and wind down process.

After filing for Chapter 11 bankruptcy in January, BCTGM rejected a final offer in September from Hostess aimed at slashing costs and allowing the company to emerge from bankruptcy.

While the bankruptcy court gave Hostess the power to unilaterally change the BCTGM’s collective bargaining agreements in early October, the work stoppage forced the company to shutter three plants on November 12.

A company-set deadline for enough employees to return to the work came and went on 5 p.m. ET Thursday, paving the way for Hostess to decide to liquidate pending approval from the court.

“A sufficient number of the Debtors' baking facilities have become inoperable, and the Debtors are no longer able to fulfill customer orders or sell product at their retail stores,” Hostess said in its 65-page bankruptcy filing.

Due to the “material impairment” of its business operations, Hostess said it will “soon lose access to the funding” needed to run the company and several remedial provisions of its final debtor-in-possessor order were triggered.

Hostess has been on the ropes for years. To blame this on the union without giving management it’s fair share of the blame is unrealistic to say the least.

Well jump, what policies that Obama pushed put Hostess in the position they are in now? Do you also blame GWB for the problems Hostess had during his administration?
 
It seems the company is telling 2 stories. They have a problem, they placed the blame on the union, instead of letting management taking any responsibility or it.

Personally with the obesity problem America has, I think their downfall has been slowly coming. The schools have eliminated this crap, responsible parents have been cutting them also. Did the union contribute, probably, but lay the blame equally amongst management and some of the publics changing their eating habits.
 
They said on the business news yesterday that the union decided to let the plant close in hopes a new owner would emerge and offer a better deal.

Of course Obama isn't the reason hostess is going out of business, but what is that old saying "if your not part of the solution you are part of the problem." We are going to hear more stories like this as more of O's policies are implemented. Increased taxes on millionaires, yup those are the business owners. Health insurance mandates, increased energy costs the list goes on. There is a reason business owners didn't vote for this guy. The apologists should wake up.

Are you for real, Obama's fault?

What annoys me about this crap is that I'm not even sure this was a Hostess only strike, reports seem to be saying that it's a union wide strike. If the union can't be sensitive to one company that employs over 18,000 workers the company should have the option to ask it's employees to go non union and maintain pay and benefits exactly as the union got them, and save the company the several dollars an hour the unions make.

In this economy it's ridiculous to hammer a company that's having a tough time.

We need union reform, not do away with them but give companies the option of reaching an accord with their employees if they feel they no longer need the unions.

Unions seem to get to where they strangle industries and it costs way too much hourly. This I base on a friend in the pipe fitters union, his job pays $35 an hour according to his hiring rate, and he sees a little over $20. I'm not sure I have the full picture from him on what the company pays and how much comes out of his pay, but I do know that the hourly union dues seem majorly excessive.
 
Better deal?? Yup,the US Government,Free rent,Free food,Free obamaphones,Free this and Free that.O will take care of his subjects.
 
Rim,I read all the employee reviews.It sounds just like the company I worked for,same exact complaints.It does make a difference to the working people who and what the CEO is.Our company owed 19 billion dollars and was in bankruptcy.They brought in a new CEO who was an ex seal and super smart.He knew how to manage people and the business.Brought the company out of bankruptcy in 3 years and kept moral up and people working hard as a team to get it done.Everyone had pride in their job and did not want to let the next guy down.We lost him to another company that wanted him bad enough to make it worth his while to go.In two weeks you could tell the difference even at my lower management position.I have been retired 2 years now and they say the place is an awful place to work now.That is a real shame.And no union involved in any way.
