Can I hunt this area?

There are many sections of land around where I live that are fenced off, but have access points every so often. They are mainly used for horse back riding.

These signs are posted at every access point.....

***A.R.S. 13-3107...(reference letter "C", number 3)...

http://www.azleg.state.az.us/ars/13/03107.htm

***A.J.C.C. ss 10-5 reads...

"§ 10-5-5 BIRDS AND ANIMALS; PROTECTION.

No person shall kill, wound, maim, injure or harm in any manner any bird or animal; or throw, fire or shoot any gun, pistol or other deadly weapon, or any stone, arrow or other missile at a bird or animal; or break, tear down or destroy any bird's nest or eggs or other contents of their nests on any publicly owned property.

(Prior Code, § 10-5-5) Penalty, see Vol. I, § 1-1-11"

My question is, would you hunt this area?

I would say no. It says no discharge firearm, motorized vehicle, etc. Check with your game and fish. They should know

It looks like Apache Junction covered all of the bases and then some to make sure there is from or fashion of hunting done on that land. A.J.C.C. ss 10-5 pretty well means you can look but don't touch.

in most city limits it is illegal to fire any projectile. airguns, real guns, archery are NOT legal in city limits around here. the no discharging of firearms statement would preclude and firearms hunting.

it is legall to shot in city limits in az as long u 1/4 mile from any occupied bulding unless posted otherwise. so u would be better off not go there shooting unless u wnt a class 6 felony

You also stated that it was Shotgun only. Well I was concerned about that also. I called AZ fish and game and they told me that the new law that passed was passed for every kind of hunting. It does not specify shotgun only hunting. The reason I called is I want to hunt coyotes in the wash behind my house that is further than 1/4 mile from residence but to close for my comfort to use a rifle. They stated that I could use a rifle in that area as long as I was further than the 1/4 mile away from an occupied Structure. Seems kind of crazy to me. I want to find a Game warden and ask him in person.

No shooting doesn't mean no hunting. Here in California all over they have signs posted "No shooting" but what they didn't put on them is "In Lawful pursuit of game". I would ask the local Game Warden, they can clear things up. Just because it says no discharge doesn't mean no hunting. Adam

I would hit up your local city office thats in charge of those areas myself to verify NO HUNTING.
You can also hit up your DF&G as it may even be listed as a HMA (hunting management area) that only a few know about.

An average 8 year old kid can surely understand this. Right?

No [beeep] sherlock, but A.J.C.C. is Apache Junction City Code. The ARIZONA REVISED STATUTE (^^the link I posted ^^) says...

"C. This section does not apply if the firearm is discharged:

3. To lawfully take wildlife during an open season established by the Arizona game and fish commission and subject to the limitations prescribed by title 17 and Arizona game and fish commission rules and orders. This paragraph does not prevent a city, town or county from adopting an ordinance or rule restricting the discharge of a firearm within one-fourth mile of an occupied structure. For purposes of this paragraph, "take" has the same meaning prescribed in section 17-101."

It states that hunting is allowed as long as it complies with AZG&F rules. It says they (the city) can only restrict the discharge of a firearm with in one fourth of a mile from any occupied building. They can't restrict hunting completely.

And I found this on the AZGFD website...

"Changes to A.R.S. §13-3107 and A.R.S. §13-3108 transferred the authority to regulate discharging a firearm while lawfully taking wildlife within the limits of any municipality, park, or preserve during an open season to the Arizona Game and Fish Commission."

This pretty much rules out the city code.

King Zero you are correct. A.R.S. §13-3107 and A.R.S. §13-3108 transferred the authority to regulate discharging a firearm while lawfully taking wildlife within the limits of any municipality, park, or preserve during an open season to the Arizona Game and Fish Commission."

This supersedes all municipalities codes and laws. However I would check with a Game Warden just to get crystal clear information just so you can be sure not to get into trouble.

Are you going to hunt with the hikers on Silly Mtn Road? I have always wanted to hunt the golf course in Gold Canyon. I suggest carrying the new regs in your truck when hunting the new open areas. Not all LEOs know the new regs. Walking through a park with a shotgun gets alot of attention so be safe and cover your bases.

Sherlock here. You mean to tell me after reading the sign and after reading A.J.C.C. ss 10-5, You may still be able to hunt behind the sign? HUH?

Good grief, AZ is more screwed up than CO is.
