Only ONE is able to be tried under the UCMJ. As the others are 1 from the CIA, 4 are Veterans, not retirees. The one that is retired Navy captain. Veterans are not subject to the UCMJ for x number if days ( usually 30-60 days) UNLESS they committed a crime while serving. Because Retirees are on the Branches payroll they are subject to the UCMJ. Had he turned down his retirement he would not be subject to the UCMJ.
No DC court will convict politicians.
That may be true. BUT, if Charged the DC courts have NO jurisdiction in a Court Martial IAW the UCMJ under Title 10 United States Code.
The Military Courts have a 99% conviction rate.
Now is there an appeal yes there is, each branch has a appeal for the Army it's normally the Army board of corrections, After that it's the Supreme Court IF they want to hear it. There is NO other branch of the judiciary eligible or able to hear the case.
The military has built-in protections for convicted service members, including automatic review of special and general court-martial convictions.

NOW do I think that the Branch would pursue it .... maybe, maybe not. Actually I suspect they would pass on it. As the senior flag offers are "suppossed" to be a politcal. but in reality they are just as political as the Legislative, Executive, and Judicial branches are. That said the POTUS does have the ability to revoke the commission status of ANY Officer on the spot for ANY reason. Which means no beenies.

It would boil down to IF the Branch JAG interrupts it as a threat to their AUTHORITY to convey orders, in other word if the Secretary of the Navy's Staff "thinks" "Feels" "perceives" his comments as a threat to their Legal Authority. They will turn on the boiler and fry his but Sitting US Senator or not, he is a retiree and subject to their "SOLE" Jurisdiction IAW with US Code Title 10.
If the JAG office in Washington perceives that threat yeah they will burn him alive, No press, NO disclosure until done completed. No interviews... Pass go straight to jail.
To Which under the UCMJ the following charges may or could be used (just a few that comes to mind quickly):
