No new TC's in California?

This may be old news to you folks, but went to try and buy a new frame, was thinking about an Encore. Was told that TC opted not to put their guns through the new safety testing that CA is requiring (can't say as I blame 'em), so there are no new ones, nor used from the dealer. They can, however, facilitate transfers.

Please let me know if you know otherwise - I do know I haven't been able to find any here in Sacramento...

Can't tell you how happy it would make me for work to move us there or AZ. Don't want to start a war between which is best (TX or AZ), it's just that when you live in CA, just about anything other than New York sounds good! :)

1buba...I share your grief....this place bites. We're moving in May or so as soon as this WebMaster school is finished. We're going to El Paso or San Antonio..looks more like El Paso though. This is not the place to be when you have this disease.

What kind of safety testing do they want to do in CA? Chamber pressure? Sear engagement? What? Curious minds want to know.

I can't understand it. It looks to me like the safty testing applies to "concealable" handguns only... I'm going to have to call TC next week.

We have the same problem here in MA. Our AG pushed through a whole bunch of restrictions under the guise of consumer protection. There are very few new handguns that are allowed to be sold here because of the testing that they are required to go through, and all the other safety stuff that has to be put on them. They are very bogus regulations, just designed to try to keep us from owning handguns.

I have some concerns still about whether or not a frame sold originally as a rifle can be changed to a handgun. Not because of the actual law, but because of the way some donut eating, coffee swillin', dark glasses wearin, anti-2nd ammendment "officer" of the law might interpret the law to say...
(my discription is meant to seperate the 1-in-a 1000 odd-balls on the force from the good guys)

There has been much debate about converting a factory shipped carbine into handgun configuration. As far as I can tell by studying the legal issues, there is NO question, converting a factory shipped carbine to handgun configuration results in an unregistered NFA firearm.

----------BUT----------

For those who don't believe me, the following is an excerpt from a post on another board. The gentleman who wrote the post took my advice and called the number listed (after receiving some wrong advice from his local BATF office!)and his post is based on the conversation with the BATF folks in DC, the "Technology Branch", that interpret the laws.

Ok, called the number Gonhuntin posted (Technology Branch BATF(202) 927-7910) and worked them over as best I could (never play poke the bear with big brother...unless the stick is very, very long) IF your contender was sold as a pistol- you could put any barrel on it, 14,16,21,etc. IF, big IF, you purchased the TC as a frame only, when you filled out the "yellow" form, if it was registered as a long gun you must keep a carbine stock and legal barrel on it. In other words, its a one way street with the frames- buy a remington 700 action in the white and have the dealer check off "handgun" and you may build a pistol with it. Buy a Contender carbine complete, and you CANT put a pistol grip on it- you just converted it to a short barreled rifle.

So, take or reject any other advice as you choose, but KNOW that the BATF says if you convert a factory rifle or carbine to pistol configuration, you now have a class 3 firearm!!! Possession of an unregistered class 3 weapon is punishable by up to 10 years in prison and a $250,000 fine....for the first offense!
 
Hi, actually you can buy new fully assembled rifles in California but pistols are questionable unless they are of the collectible or limited editon models usually consisting of 500 pieces or less produced by the factory. Contact Mike or Myrna Dyksman at M&M Trading Post. He is probably the largest COntender only dealer in California and attends most gun shows in the state so he is up to date on all the current laws in this state. Thanks - that's what I've been looking for. The shops here in town say they can't, but I've had a hunch that they really mean "won't". I'll give them a call. (Where 'bouts do you live?)

BTW, I did write to TC. Good luck understanding it. I understand the difficulty they face in maeking me understand it though. :)

Dear Sir:

At this time I doubt if we will be selling Contender and Encore pistols in California after Jan.1, 2001. We are examining the current rules and regulations that California has prepared. Just when or if we will make pistols available for testing cannot be determined at this time.

The information listed below is in response to your letter checking on the legality of switching Encore components between rifle and pistol or vice versa.

Thompson/Center Arms Co. went all the way to the U.S. Supreme Court to establish the lawfulness of the Contender pistol and carbine (including the carbine kit), and won. The Supreme Court opinion also establishes the legality of the Encore system, which has similar interchangeable parts.

With these systems, a receiver may be assembled either with a pistol grip and pistol barrel, or with a shoulder stock and rifle barrel (minimum length 16 inches). A barrel under 16 inches in length must never be assembled onto the receiver when the shoulder stock is attached. Within that parameter, the consumer may use the parts to make a pistol or carbine, and may change the configuration at will.

In 1988, Thompson/Center Arms filed suit against the United States alleging that the pistol and carbine kit as used above do not constitute a rifle with a barrel less than 16 inches in length, a weapon made from a rifle with overall length less than 26 inches, or a restricted “firearm” as otherwise defined in the National Firearms Act. The US Court of Appeals for the Federal Circuit and the US Supreme Court agreed with Thompson/Center Arms. Their opinions are cited as United States v. Thompson/Center Arms Co., 504 U.S 505 (1992), affirming 924 F.2d 1041 (Fed. Cir. 1991).


Thus, the sale, possession, and use of the Contender or Encore pistol and carbine as described above are fully in accord with federal law. The use of these products in all of the States is likewise lawful, except that certain restrictions may apply in California.

Hey, I am glad you found the TC info helpful. Mike should be able to answer all your questions about the current laws and I also have a private dealer in Sacramento who has great prices on TC rifles as well. Oh yeah I am located in Sacramento, closer to Elk Grove with a friend who is also a TC shooter in Roseville. Give me a call on my cell at 761-4051 or home at 682-9046. I have answering services on both so leave a message as I check both often but the cellular more often than home or just shoot me an e-mail. Well I was going to find some yotes this morning but decided to wait until I find some flatter property to use the quad on. My usual property above Plymouth is being heavily hunted by squirrel shooters right now along with some timber cutting also but by spring should be ok again for yotes. I am usually found up in the Spenceville area for yotes also but once again overrun with all types of hunters as well so I am holoding off until next week before venturing out once again. I sent you an e-mail as well in case you don't get here often. Well the wife said she ios taking me out on a date since I am not going so talk to you soon.
