They are legal in every state - but their performance is erratic, sometimes opening up explosively fast, and some times zipping through like an ice-pick and the critter runs.
I can vouch for this, as I have both witnessed this and done it myself. Sometimes OTM bullets leave a 6" diameter exit wound; sometimes they leave a pencil-size exit wound. One guy I used to hunt with got a bunch of M852 Match 7.62 NATO ammo cheap, and used it to hunt PA whitetail deer with. He usually had to shoot a deer 4-6 times to put it down - at very reasonable ranges (frequently under 100 yards). I will neither use them, nor endorse their use, on game animals, except possibly for survival situations. Good hunting bullets are readily available, frequently at less cost than OTM bullets. There is simply no justification for using OTM bullets for hunting IMHO.
