Shooting from vehicle?

I'm not posting this to start any monster discussion on ethics. The real reason is that I'm trying to settle a bet with a hunting partner.

I just returned from a turkey hunting trip in South Dakota. I am from Iowa and my buddy is from Minnesota. While we were out there we saw a person shooting at game, with a rifle, from inside his Jeep. This started up a discussion about the legality of this in different states.

How many states (and which states) allow shooting at game from inside a vehicle?

The states that we are from do not even allow loaded firearms in vehicles while hunting.

It was explained to me this way for Oklahoma,,

If you are on private land, parked, and the engine off, you can hunt from your truck. The law says no use of a motorized vehicle while in pursuit of game, I guess if you're parked you can't pursue game, they come to you /ubbthreads/images/graemlins/laugh.gif
 
Not allowed in Utah unless you are disabled, then I believe the DWR can give you a special permit to be able to hunt from a vehicle.
 
I do that all the time here in Idaho, of course I have a handi-capped shoot from a vehicle placard from the Fish and Game department to go along with my handi-capped parking placard.

That may have been the case where you were, but here in Idaho it's against the law for folks to do that if their doctor hasn't filled out the proper fish and game handi-capped paperwork and there are regulations that make it clear where you can shoot and not shoot if you do have the placard.
 
In Montana; Residents and Non-residents certified as permanently and substantially as non-ambulatory can get a permit to hunt/shoot from a vehicle.
 
Well??? What kind of game was he shooting at? Read page 44 of the South Dakota Hunting Handbook:


—No person who is in or on a motor vehicle,
except those hunters with Disabled Hunter
Permits, may discharge a firearm or a bow
and arrow at any wild animal except coyotes,
jackrabbits, rodents, skunks, badgers,
raccoons, and red and gray fox.
—No person may allow a firearm to protrude
from a motor vehicle or a conveyance
attached to it while the vehicle is on a public
road. However, a firearm may protrude from a
motor vehicle when shooting at coyotes,
jackrabbits, rodents, skunks, badgers,
raccoons, and red and gray fox.


As far as California goes, ONLY HANDICAPPED persons with a permit and an able bodied person hunting with them can shoot from the vehicle.

Its against the law here in CO. You can't even fire a gun from a trailer connected to a vehicle. It doesn't matter what we are hunting or where.

On another forum I hammered a fella that was braggin about shooting at a pig from his truck....he did miss. He was concerned about whether he hit it or not. Obviously not concerned about it enough to go see. To me its just lazy....

Shooting from a vehicle puts the image of a "drive by" in my head.

We do make provisions and exceptions for disabled persons.

OK in Nebraska (and I see it all the time), but it is:

'Unlawful to fire from vehicle at non-game species in need of conservation' ...

Last I checked 'ole Wiley' is not in need of conservation /ubbthreads/images/graemlins/smile.gif

Edited: I am assuming they were firing at non-game species.
Turkey, deer, elk, antelope, etc. hunting is unlawful from the vehicle.

In S.D. you can shoot coyotes from a vehicle parked on a road, not sure about other animals.. If on the reservations then no shooting from pickup.. In Minn. you can shoot coyotes and small game from road but have to be in front or behind pick-up and must have permission from the land owner on either side of the road...
 
Each state has different regulations concerning those circumstance, if any, in which a firearm can be used from a motor vehicle. Aside from provisions for handicapped persons, few states that I know of provide for anyone shooting at game (animals) from a vehicle. Then again, in many states, as is the case here in Kansas, the coyote is listed as a "varmint" and is NOT considered a "game animal" or "game", therefore, regulations and laws that pertain to game animals do not apply.

Regardless of how you personally feel about shooting from a pickup, the important thing is that you know and understand what you can and cannot legally do where you're hunting. The responsibility is yours to know.
 
Illegal in AZ unless you have the disabled license. To take it one step further, it is also unlawful to fire a weapon on, over, or above a roadway maintained for public use. Carrying a loaded weapon in the vehicle is OK though...unless you are using a spotlight.

Ok, what about shooting from the bed of a pickup truck in Nevada that is stopped and engine off and shooting varmints and predators? Just curious.

The law says:
"It is unlawful to carry a loaded rifle or loaded shotgun in or on any vehicle which is standing on or along, or is being driven on or along, any public highway or any other way open to the public."

I would interpret that to mean no you can't but, you might ask the cops to be sure.
 
I am pretty sure it is legal in Texas to shoot any animal from a vehicle as long as your on private land. I need to check on that to be positive.
