I have always heard you can't use a silencer or even be caught with one off the gun.
What is the real rule on this?
 
I believe that it may vary with state to state but I also know they are federally regulated on ownership and transfer.
 
IF they are legal in your state, and IF you submit the proper forms to the ATF after getting them signed by your local Sheriff or Police Chief along with your fingerprints and a $200.00 transfer tax, the ATF will send you a tax stamp for that particular suppressor (assuming you pass the BI). You need to go through this for every suppressor you own. Expect to wait 3 to 6 months.

However, owning a suppressor doesn't necessarily mean you can hunt with it...some states, even though they allow you to own a suppressor, do not allow you to hunt with one.

Sure would make hunting at night in/around urban areas go much more smoothly. In much of Europe supressors are required for hunting.

a friend said he saw one for sale in a local gun shop and thought maybe it was legal. I thought there were pretty strict regs on them.
 
If you saw it in a gun shop, it would have to be a Class III dealer. There are limitations that vary from state to state. Even though you might have one there are limitations on hunting with one, it just depends on the rules set forth by your Game and Fish.

If you don't want your neighbor to know when there cats are gone, get a dog or two...just kidding.

My friend has one and it makes doubles and triples alot easier while on stand, not to mention that it makes it nice around ranches that don't like coyote hunting.

You MUST have the tax stamp with the supressor at all times.
 
State to state laws make a huge difference. Here in Idaho we can use a suppressor for pretty much anything you want. Then in Washington I know you can own one you just can't use it. Go to the ATF's website and also call your local Law Enforcement agency and they should be able to help you out. I'm sure your state has a website that will tell you everything you needed to know.

Jayhawker has it right for how to get i one. The form you need is a Form 4. Once you have your stamp it has to be with the Class III item wherever it is. If it's registered to you and not a trust you've set up then you are the only person that can have it, so no loaning it out to your friend.

I've seen some guys here take their Form when they get it back and get it copied, laminated, and shrunk down so that they can keep it in their wallets, so they never have to worry about forgetting their stamp. Pretty smart on their part IMO.
 
Go to silencertalk.com they have everything you need to know about them. I have three now and a fourth on the way. Just waiting on the Feds.

In short, the answer is, because you can.
Perhaps it's an issue of what you are entitled to have versus need to have.
I am a believer in the more people who exercise the second amendment, the stronger the second amendment becomes.

AMEN to that for any of you living in a Kommie state like CA you certainly would under stand this statement!! For those of you lucky enough to live in a fairly pro 2nd amendment state increase gun control is lurking around the corner.
 
If I remember correctly, in the great communist state of Washington, it is legal to own a suppressor/silencer. However, it is not legal to USE it.

In Idaho, not only is it legal to own one, you can hunt with it too.

There are Federal rules and State's rules.

The thought on Silencer Talk forum is spot on as most of what's already posted above.

Washington State allows you to legally own a silencer but you can't shoot it ....... on or off a firearm as I understand it makes no difference ...... just can't legally shoot it ....

...... a LEO would have to witness you discharging the weapon with it installed and then it's a gross misdemeanor .... AFIK.

Makes so much sense just like so many other laws.

The idea of making copies of your tax stamp is a must .... for that matter any special firearms license or tax stamp should be copied and the original stored FAR AWAY from the grabby little hands of ATF agents is a WISE MOVE!

More than a few Class III firearms have been jepardized by a Federal agent walking off with the original document and then saying "what tax stamp"!

Pack the copy ...... not the original!

JMO The answer I give if asked why I have a conceal carry permit, "because I can".
 
You can hunt with them here in WV. They are great when hunting ground hogs in small barn lots or barn yards. I have sole hunting rights on several horse farms because of a suppressor. The horse farmers like it when I show up to hunt. They hate ground hogs and their horses hate noise. Works out great. Just a quick sonic crack and a dead ground hog. I even have a sub-sonic load worked up for shots 75 yards and in.

Why have one mostly, for noise reduction. Your ears would love you more if you had one.

I have read claims that places in Europe, it is illegal to hunt without one.

I read an article ealier this year and they claimed that when used for calling that most Coyotes that were missed ran toward the gun. They said reason was that all the Coyote heard was the crack of the bullet going over them and the impact of the bullet so they would run away from that sound.

I was at a Varmint Silhouette shoot a while back and a guy had one on an R15 and it made it sound like a 22 when he fired his rifle.
