Family of girl killed in armed robbery retains wrongful death attorney

The family of the 17-year-old girl who was shot and killed by a Kokomo police officer during an armed robbery on Friday has retained an attorney to look further into what happened.

Richard Waples, an Indianapolis-based lawyer, is representing Michelle and Teresa Haendiges, the parents of Shelly Lynn Haendiges, who was killed during a robbery in progress at Casey's General Store, 1502 S. Dixon Road, Kokomo, at about 5:30 p.m. Friday.

"The family is shocked and they're grieving," said Waples, who specializes in litigating wrongful death, conditions of confinement, false arrest, police misconduct and other constitutional claims and consumer class actions. "At the same time, they're hurt and they want to know exactly what happened, as any parent would."

Waples said he has contacted the City of Kokomo and would like to review video and any evidence associated with the incident as soon as possible. KPD plans to forward the case to the Howard County prosecutor for review after the investigation is complete. KPD spokesman Maj. Brian Seldon said he could not predict when the investigation may be concluded.

KPD said Saturday it is the department's policy to withhold the names of juveniles involved in any crimes; Waples confirmed the 17-year-old girl's identity.

Roy Smith, a 10-year veteran officer, shot Shelly Haendiges twice after she pointed a gun at him. According to information released by the Kokomo Police Department on Saturday, Smith told her to drop her weapon, which she had been pointing at the Casey's General Store clerk. Shelly died on the scene. She was armed with a CO2-powered pellet handgun, Seldon said.

“It resembles a real gun. You can’t decipher whether it’s a real gun or a fake gun,” Seldon added. “How would the office know? There’s no way.”

There were other people in the store at the time of the robbery, in addition to the clerk, Seldon said, and people outside witnessed the incident too. One of those witnesses called 911 while the robbery was in progress.

“He was giving us a play-by-play of exactly what she was doing,” Seldon said. “We’re looking at possible surveillance from all the locations in that area. There is some footage, but of course we can’t release it due to the ongoing investigation.”

At this point, there is no indication of Shelly’s motive, Seldon said.

Shelly Haendiges had completed her junior year of high school through Bridgeway Academy, according to her obituary. She was described as loving the Lord above all else and was active in the Chapel Hill Christian Church youth group. She loved being outdoors, tending to her animals, fishing and four-wheeling. She loved her family, especially her brother, Greg, and her cats, Midnight and Callie.

I'm actually surprised that the liberal whackos and gun grabbers haven't called for bans on toy guns and Co2 type guns. Look how many kids are being shot while using these. Maybe they have and I wasn't listening. But they always want to blame the [beeep] gun.

Mess with the bull, a get the horns... LEOs don't give a sh!t what color you are... Someone stupid enuff 2 point a pellet pistol at a cop needs to be removed from the gene pool... Our society is getting dumbed down enuff as is...
