What a terrible shame. What if that would have been you and Michelle? Or my wife and I? That puts it personal. I agree, the guy should be executed.

now days they dont even put people who have been proven guilty in court to death for killing someone...they sit in jail for 30, 40 over 50 years /ubbthreads/images/graemlins/angry-smiley-055.gif /ubbthreads/images/graemlins/crazy.gif

I have no sympathy for that jerk or any other drunk driver! /ubbthreads/images/graemlins/mad.gif

Sleep it off in the car or even in the ditch for all I care... just don't drive and endanger others! /ubbthreads/images/graemlins/angry-smiley-055.gif I think there should be a right to just shoot the SOB's on the spot! /ubbthreads/images/graemlins/mad.gif
Last night a 24year old drunk rolled his truck near my farm and died on the scene, real nasty mess. The road was blocked for about three hours and the fire department had to wash down the roadway. He refused to let his buddies take him home... stupid is often dead stupid... at least he didn't hurt anyone other than himself and his family that now has only a memory of him.

Glad you walked away! Take care.

TJNJ, Don't let the insurance company or their attorneys push you into a settlement...

Find the meanest, dirtiest lawyer in the area and get your case started now... While witnesses, including the officers have everything fresh in their mind...

I do Private Investigative work for attorneys and usually get a case when it's 6-12 months old and getting a viable statement from witnesses is almost useless. Too much happens in everyone else's life and the memory loss is natural, but unfortunate.

It's too bad the other guys alcohol content wasn't a little higher as the average person is passed out after .30-.33..then he would have been unable to drive for a while.

Also look real hard at the other guys past record.. If he has been convicted previously and given a slap on the wrist as a punishment, you might be able to go after some of the politicians involved.... /ubbthreads/images/graemlins/grinning-smiley-003.gif

Im really sorry to hear your unfortunate situation. I would not accept a single dollar from the insurance because when you do, they will consider it settled. I believe that your own insurance may work on your behalf against them but I may be wrong. If you hire an att. be prepared for them to take a good chunk out of your wallet too. If your going to sue that guy and his insurance, you need to be visiting a doctor for any injuries, including mental ones that this may have caused.

nearly everyone here has had one drink and then driven, but even that is 1 too many.
my point is that if you know ahead of time that you are going to have even 1 drink make other arangements ahead of time, often times 1 leads to more.
My cousin stopped at a friends house and had 1 beer then headed home.On the way a little girl ran out in front of him and was killed.Even though there were no charges filed against him he never forgave himself. was it his fault? NO.
could he have stopped the truck had he not had that 1 beer? he'll never know!

Did he have insurance? Which company offered you the six thousand? I wouldn't accept it either, however, most often insurance won't give ya squat for aftermarket parts or work. Basically they operate off the blue book price and anything extra you put in a vehicle is mostly on your dime. I've seen so much needless death and severe injury and suffering caused from drunk drivers over the years in my careeer. I have zero sympathy for them. Here is a repost from one example I've had to deal with:

Quote:
I once held a beautiful little four year old girl as her life drained away from her because a drunk driver hit her mothers car. I worked frantically to save her and she died in my arms while her terrified mother looked on. The driver of the other vehicle was so drunk all he did was yell at us occasionally about how badly his car was damaged as he walked around basically unhurt from the collison. I charged him with DWI and Manslaughter and he was sentenced to seven years in prison and released in three years and one month. He drove drunk against the advise of all his friends that night because he didn't want to look like a wimp in front of some chick he had met at the bar that evening. He made a decision that cost a wonderful family their daughters life, and, many terrible memories for all of us at the scene that night. It isn't fair... /ubbthreads/images/graemlins/mad.gif

the is one of the sadest thing i have ever heard
all i keep thinking about is if my son was in the car or i was not infront of the family that was behind me
i got lucky my back hurts but over all that is it
the only thing that i hope for is that he figures out that he cant was an idiot for driveing but something tells me that he wont
maybe next time i wont be the one in the way of the family and someone dies

about 7 years ago I was heading home about 6:00 in the winter, so it was dark. I went around a bend in the road and met a woman who who was driving on my side of the road, /ubbthreads/images/graemlins/shocked.gif we hit head on doing about 35 MPH.

I had a 6 day old car with 300 miles on it.
it was totaled, luckily for me, all the crumble zones, air bags and seat belts did their job and I had no injuries at all. when the cops arrived they went to the woman 1st and she was abusive to them, so they came over to talk to me. up until that time they were still trying to be nice to her. while they were talking to me, she started her car up, put it in reverse gunned the engine and smashed into the cruiser behind her. well..... the cops lost all their good feelings towards her, dragged her out of her car, cuffed her, and tossed her in the back of the good cruiser.

they found an open bottle of vodka on her pass seat (therefor no smell of alcohol on her), and this was her 3rd accident while OUI. /ubbthreads/images/graemlins/smiliesmack.gif

funny part was when I went back to the dealer about a week later, the sales man was there and asked me how I like the car, I said it was great and could I have another one just like it /ubbthreads/images/graemlins/confused.gif I told him the story and they sold me the 2nd car for what the insurance company gave me for the 1st one. /ubbthreads/images/graemlins/grinning-smiley-003.gif

Had the misfortune to work with a guy just out of rehab for a felony DUI. 9 months in there and it didn't teach him a flipping thing. He still drinks, just at home for now. He can't get a valid drivers license for 50 years but he still drives. Give him time he will be on the road drunk again. And I hope he gets caught the first time and sent to jail this time. He just can't understand that you don't do certain things.

If he does drink and drive....turn him in. Better that than destroying some family.

Luckly for me I don't work with the moron anymore. He was on a job and started telling the boss how the job should be done and she both a. didn't like it, and b. didn't have to put up with it. She also knew she didn't have to put up with his nonsense. He got sent down the road. I am highly unlikely to see him again and I will be just as happy about it.
