FTF gun sale/Trade

Well I haven't seen a post like this so here goes, I am probably going to trade one of my used rifles to a gentleman, he is going to be trading a brand new rifle to me for mine. My question is.... can you or is there a phone number to call to check serial#s to make sure it is not stolen? next part of the question...would it be rude to do so in front of the person. This will take place in Texas, which I have learned is legal to do with a bill of sale or a form 4473 which would eliminate a FFL and there fees.
 
No 4473 or FFL required. However a bill of sale is a good idea. That and verify the dude that fills out the BOS is using his actual name. Just ask to see a drivers license or something...JMO.
 
FTF I make 2 copies of a bill of sale before meeting, tell him I need DR# and we both sign the papers. The serial #, make, model, caliber goes on my BOS. If its at my home I attach his DR to it and scan it to the BOS.
If he looks or sounds shady I pass, but have never had that issues in 40 yrs.
 
Yeh I wasn't 100% on the 4473. Just want every thing done right no loose ends. I will probably meet half way and was thinking of taking a pic of his DL.

This is basically what I do, and what the past couple buyers/sellers I've done FTF deals with have done. It's very simple and protects both parties.
 
I wouldn't be overboard with concern, just make sure he is a resident of TX. Yes, give some evaluation to his makeup. You can always track him down later if need be, with contact info.

I have mostly just cashed and carried with FTF transactions.

Save hotgunz.com to favorites on your smart phone, IF the deal looks suspicious when you meet, run the number and hope he isn't offended. If he and the deal look legit, make the deal and walk. You're both getting a used gun out of the deal, you're both getting a gun the government can't track out of the deal. Sounds like he's assuming more risk than you are; if your gun's older, it's had more time to commit a crime. My responsibility in helping the government track guns, ends at filling out that 4473 on dealer purchases. PERIOD!

While I don't get excited if someone wants me to sign a bill of sale after glancing casually at my ID, I'm not going to be happy if they want to photocopy my drivers license, or write all of my information down, if they're not a licensed and bonded business; that would be a deal stopper for me. (And, I'm sitting here on the computer while the Lifelock infomercial, harping on Identity Theft, plays on TV, reinforcing that position). They already have your phone number, probably have your e-mail address, and in giving them a photocopy of your driver's license, you have just supplied them with your Legal Name, Date Of Birth, Street Address, and Driver's License Number. I assume most of you have a mailbox outside your house at that street address, where your credit card and bank statements get delivered at about the same time as everyone elses' every month, and tax documents that might disclose your Social Security Number might be delivered, about the same time everyone else's are delivered. And, documents with your spouse's and children's names are delivered, what schools your children attend, mail from family members is received, etc. etc.

Uhmmmm, NO... I'm sorry, but I'm not going to give you my Drivers License to copy, nor am I going to let you write all of that information down gentlemen. And, I don't want a copy of yours, even if you are prepared to give it to me! If my refusal offends you, that's just tough [beeep]; I really don't care; you requesting such offends me!

I've never made a gun deal I didn't feel safe in making, including the one guy I met in the parking lot at the Biker Bar. If it looks suspicious, in any way, I simply tell them the gun isn't what I was looking for and walk away. If the seller bought the gun used, and he can't provide a background on it, run the number. If he bought it new, and doesn't look like a criminal, we're going to deal.

Thanks Rocky1, good advice that I'll heed, The govt. has too much over reach anyway.
