gate problem with new 1895 marlin .45-70.

picked up a brand new marlin 1895gbl. just narrowed it down to why my new gun wont feed or load worth a crap. the magazine gate isnt closing all the way on its own. doesnt matter if i load one round or the whole tube or none, i hafto manually help the gate fully shut by prying it down and out with a small screwdriver. if not the gun jams up solid. the top of the gate is catching on the top of its opening. seems like its bent up, or out of allignment. is there a simple adjustment to alligh the gate better in its opening. its not out by much but just enough that it wont work. i could fix it by filing it down a little bit, just wanna make sure there isnt a simple adjustment for that first before i file down. thanks!
 
Bring it back, see if they'll give you another that works correctly. Other than that, your solution sounds simple enough, and should work.

I owned the regular 1895 classic 4570, loved it, didn't find any problems. Federal Fusion 300 grainers shot well out of it, 1" 3 shot groups at 100, 1 1/2" 5 shot groups, with aperture back sight, blade front and steady front/back rests.

im trying to take out the gate to file down, i did the standard field strip of the gun and took out the gate screw, is there a special trick to sneak the gate out of there or what else do i have to take apart first?
 
after further inspection i find its not only the gate binding on the opening, its also the long slender gate spring i guess you could call it, that binding in its grove too. seems too much for a simple filing job. guess i gotta figure out whats involved in returning the damm thing. im in canada so sounds like a hassle!
 
I am on Marlinowners also and the has been alot of talk this past year on Quality control issues since Remington took over. I have nothing newer than a 1990 336CS I like the older Marlins, they just seem to look nicer, and seam smoother.
 
well i got a new gun, the store i bought it from exchanged it for a new one. to my dis appointment i realize now that the old gun was the marlin made one and my new one is the remington made one with the remington logo stamped on the right of the barell. this one functions and cycles just perfect actually. but the finishing quality is definately not the same, the rear stock fits sloppy and the front and rear stocks are not the same color and finish at all!!! i wish i noticed that in the store in their crappy light. but that color difference is really bugging me. seems like someting stupid to return it for at the store AGAIN! what do you think marlin would do about this?
