I can understand why the goverment/CIA would want to keep certain people "detained", but now look what happens to are rights, what would happen if I or You would become detained,
IE: Not see eye to eye with certain leaders because of your or my political views?

With no Hebeas Corpus, Could we/you/I be taken in to custody for our political views, mabie based on the way we voted?

Politically and economicly the USA today in some respects kind of reminds me of Germany in the early 30's.

In light of some of my research on the NWO, and the AMRO, along with the crashing dollar, NAFTA, uncontrollible imagration, Huge national dept, the national ID CARD on the horizon, etc, this Hebeas Corpus is REALLY, REALLY, a big deal, and from what I understand it is THE corner stone of are constitutuion and yet I heard hardly anything about it,

It was in and out of the media spotlight very quickly, from what I have read, It went though congress faster than happy hour noon cocktail!

I haven't heard much more about it other than it is back before congress?

Am I just paranoid? /ubbthreads/images/graemlins/confused.gif

Habeas Corpus is the Constitutional (6th Amendment) Right To a Speedy Trial and means "Produce the Body"

Suspension of the "Writ of Habeas Corpus", means that you can be 'detained' (read - Arrested) and held without formal charges being brought against you, and without access to counsel or trial...

We hear a lot about the 1st and 2nd Amendments, but very few consider some of the other Eight.... That were considered equally important by our nation's founding fathers.... Based on the actions of King George and things that precipitated the Revolutionary War....All of the Amendments following the first ten, were added by votes and ratification for the general population..

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Well if they had practiced what they should have been doing on the battle field "Hebeas corpse" we wouldn't even be talking about this BS.

There are 2 issues with the current administration's desire to dismiss habeas corpus... both are quite disturbing, at best - and sinister at worst (IMO, the latter applies - while some can call 'W' an idiot, dummy, stupid or worse - IMO, he and his neo-conservative ilk know EXACTLY what they are up to. They just hope they can paint folks that question their questionable practises as 'kooks', 'nuts' or 'unpatriotic'. Shucks, we see that here in the Painful Truth, folks attempting to minimize other peoples' real concern at the direction our country is headed.
Anyone, again - IMO, that blindly follows any leader without question are bound by a faith that is much stronger than mine toward mankind. The Bible has taught me that Man is evil, fallable, despicable, desiring power over others. Only the Triune God can be trusted, and trusting in any item besides God and His Word can be akin to a form of idolotry.
Sorry to those who disagree with me, but sometimes the Truth is Painful, eh??? lol

Anyway, here are the issues that I have with this attempt at the suspension of habeas corpus.

#1
By not allowing a speedy trial, folks can and will be held - 'detained' - for indefinite periods. Shucks, all one would need to be 'detained' is someone with an agenda against a person - make up some baloney about ties to coercive groups, and voila - without judicial oversight - without the ability to contact counsel - without habeas corpus, one quickly becomes a non-entity. No longer a sovereign, as described in the Constitution, but a nobody - without any rights.

#2
By not allowing folks to have a trial by jury of peers, the only arbiters of justice become the government itself. Jury nullification allows the citizen to dismiss laws that they find to be against the sensabilities of the people. It has potential abuses - i.e. O.J.Simpson - but the potential abuses of not having the ability for a jury trial are more heinous, IMO. Let's look at California - the Republic of California, some time ago, has made Medical Marijuana legal. Feds decided that the 10th Amendmant no longer applied, and have looked into prosecuting Doctors who prescribe it for their patients. A trial-by-jury could allow the nullification of these "Federal Crimes". Whether or not one agrees with using 'the weed' as medicine isn't the question (thankfully I live on the East Coast, so I don't have to put up with Kali's wackiness). What is at the heart of the question is that Doctors could be prosecuted and thrown in Federal Prison for following their State's guidelines for medical practise. A trial by jury would ensure that folks other than Federal hacks are hearing the facts and deciding the outcome of these potential life-changing events. One, if one had the poor opinion of government, could easily see Federal Police arresting folks, handing them over to Federal Prosecutors who then prop them up in front of only a Federal Judge, behind closed doors with no-one allowed to know the 'evidence', 'witnesses' or outcome.

So in WW II how many Germans and Japanese had habeas corpus. Zero and that's the way it should be today. Some of these people would bring them to America turn them loose and put them on welfare to practice their trade.

The topic is the suspension of habeas corpus for AMERICANS. I have to assume that you realize this.

By your logic, the treatment of Japanese-Americans during WW2 is okay? It's okay to 'detain' American citizens for how they might feel? On no other evidence but a whim? I'd like to know who proposes that we bring folks that wish us harm into this country - I will say, though, that a vote for McCain,Hillary,Obama is the best and quickest way to allowing the porous border to remain open to the invasion.

Thanks for the input guys, I makes me think about something I once heard, I think it came from one of the framers of the constitution it was along the lines of "it's better for 10 criminals to be set free than 1 person wrongly put in prison"

Do any of you guys know who said that?

BTW Turtle, I am a pup(36), I just happen to love history.
