The King County Sheriff's Office released video Friday from a holding cell where a deputy is accused of pummeling a 15-year-old girl who kicked her shoe at him.

The video was disclosed one day after Deputy Paul Schene, 31, pleaded not guilty to misdemeanor assault in King County District Court.

Schene, an eight-year veteran, remains on paid administrative leave while the case is pending. He works out of Precinct 4, which covers SeaTac, Burien, and high crime areas in White Center and Skyway. He is the third sheriff's deputy since 2006 to face charges on allegations of excessive force. All three are from the same precinct.

"We take this very seriously and we're very concerned about this," sheriff's Sgt. Jim Laing said Friday, referring to Schene's case. An internal investigation would begin after the criminal case is finished.

The girl was arrested on Nov. 29 after she was caught in her parents' car, which had been reported stolen from her parent's home in Tukwila. Deputy Travis Brunner spotted the car driving without headlights about 3:45 a.m. on 32nd Avenue South in SeaTac and pulled it over.

She and another 15-year-old girl were arrested and taken to SeaTac City Hall to be fingerprinted before being transported to the youth detention center.

The Seattle P-I requested a copy of the video and all reports from the incident under the state's open records law. A judge on Thursday denied a request from Schene's attorney to bar the video from public disclosure.

"We had argued strenuously that the videotape released to the media this morning not be released because it does not tell the whole story of the incident," attorney Anne Bremner said in a statement.

"As we argued to the judge, it will inflame public opinion and will severely impact the deputy's right to a fair trial. We will defend this misdemeanor case in court. No story can be sliced so thin that it does not have two sides. We hope that judgment will be reserved until all the facts of this case are given fair consideration in court."

County Prosecutor Dan Satterberg said in a prepared statement that the case goes beyond police misconduct.

"It's about criminal misconduct. And that's why he needs to be prosecuted," he said.

The video shows Schene and Brunner as they escorted the girl into the holding cell. Schene had asked her to remove her basketball shoes and as she slipped out of her left shoe, she appears to kick it at Schene.

Schene then lunged through the door and kicked her in the stomach or upper thigh area, court documents say. He shoved her against the corner of the cell before throwing her to the floor by her hair. He then sat down on top of her and makes "two overhead strikes," although it's unclear from the video where the blows land.

Schene is 6 feet 2 inches tall and weighs 195 pounds. He and the girl exchanged words as he led her to the holding cell, court documents say.

The video came to light in December after a detective investigating the auto theft case viewed it. The detective forwarded it to a supervisor and it was assigned to the internal investigations unit. Prosecutors reviewed it before filing charges.

The girl said that she couldn't breathe after the incident, prompting the deputies to call paramedics. The P-I is not naming her because she is a minor.

Paramedics decided that she didn't require hospitalization. Felony charges require proof of serious injury.

"If the matter were to go to trial, he could face additional charges," said Ian Goodhew, deputy chief of staff in the prosecutor's office.

In his own report from the incident, Schene wrote that the shoe hit him in the right shin, "causing injury and pain." He wrote that he "placed" her into handcuffs and that she needed medical attention for a "panic attack."

He wrote that he required treatment at Auburn General Hospital for a "blood filled pocket" on his shin, according to his report. The video, however, appears to show his shin strike a metal toilet in the cell as he pushes the girl against the wall.

The Sheriff's Office policy manual says deputies should use physical or deadly force only when "necessary to effect an arrest, to defend themselves or others from violence, or to otherwise accomplish police duties according to law."

Schene could face up to a year in jail if convicted.

The girl told investigators that she didn't intend for the shoe to hit him, court documents say.

Deputy Brunner, however, wrote that the girl became "real lippy" and called the deputies "fat pigs" after she was arrested for investigation of "auto theft."

Good grief,

Though, not knowing all the facts, I do wonder if it is standard practice to pick her up by her hair?

He and the girl exchanged words. Brunner said she was "real lippy" after being informed she was under arrest and called them "fat pigs."

Also, prior to this,

while on administrative leave, Schene was stopped for driving under the influence.

He had been drinking and taking prescription medication, according to court records. He received a deferred sentence and was placed on probation, records show.

I'm sure everyone gets this, /ubbthreads/images/graemlins/smile.gif OK "sarcasm off".

I don't care what she did, a 15 year old girl is not handled that way. This is another example of police officers being out of control.

Looking at the video it looks like she barely flipped it at him. Sure she shouldn't have done it but it looks like he flipped out and nailed her a good one. I've never been a cop, and I know they have to put up with a bunch of crap, but that was pretty bad. No telling what she had been saying to them up to that point that might have contributed to his actions. I suspect you should have a pretty thick skin if you are going to be a police officer, (or a poster on a public forum!)

Just my observation.

That is one bad dude, pummelling a little girl like that and then throwing her to the ground by the hair, and then picking her up by the hair. Tuff indeed. Come on, how bad could a "basketball shoe" hurt your shin. I have bashed myself with pieces of rebar that peeled the skin for 3" down my shin, but I didn't beat up the rebar though.

Seems a wee tad bit excessive maybe... /ubbthreads/images/graemlins/crazy.gif

I will say that is a scummy area down there by Seatac and Tukwila nowadays. Those officers see a lot of dreck in a shift. That doesn't excuse improper behavior, but I'm just giving a little context.

If that was my daughter, this turd had better find a hole to hid in. These "bad cops" get away with this because they are allowed to. This kind of behaviour is rewarded by fellow officers and there supervisors. The corrupt court system won't put the hammer down on these "anti-social misfits". More and more of these wannabe "paramilitary" cops are replacing the good LEO's and this kind of stuff is getting more prevalent.

What ever happened to the cop on the beat that wore blue and knew all that lived on his beat? There not military. There dress should reflect that of a police officer. Shaved heads, military garb, they look more like neo-Nazi's then your local police. I don't know how the good cop's put up with these bad apples in there ranks. I know some guys don't want to make waves so it don't hurt there retirement.

Maybe a good old fashion blanket party is in order! And don't forget the ivory soap in a sock!! /ubbthreads/images/graemlins/ooo.gif

There was a time when the public trusted police officers to make the proper judgement and dish out the appropreate punishment without having to jail and try and individual in court.
As a young kid up to no good at times, a policeman roughing you up a bit was far better than to become part of the court systems justice. When that happened you had a record, and it was your parents who suffered most.
Ex : When a policeman caught you in a part of town in the wrong time of night, they new you were up to no good . They couldn't charge you with anything cause you hadn't done any wrong yet. But they could make your trip there an unpleasant one not ever wanting to think about it again.
I do not have the faith in Police Depts like I once had. But we do not know the circumstances of the video, Questions arise for me. Was she a mother, was she a gang banger, is she using "Smack" or "Crack ". Would she be turned out by the legal system with no real punishment.
We have to give our police officers more latitude, without it they are un-effective.We also have to guard against those who would miss use their authority for personal gratification.
I would need more than that video to pass judgement. This comming from an individual that never got a beating I didn't deserve and not getting near enough.

I'm just going to make a wild azz guess here and say that the cop in that video is going to be joining the unemployeed ranks, very VERY soon, that is if he hasn't already.
