Murder Trial update- WELL ITS OVER

The latest news as of 9-29-08.

Both sides rested their case today in the penalty phase of the trial. A capital murder case always has a second phase after the conviction so the jury can decide if the case warrants the death penalty. Since the conviction, it was not my opinion that things were going real well. The defense called numerous witnesses including several Clinical and Forensic Psychologists as well as Family members of the defendant, Donald Rolle. The Psychologists are basically hired guns to paint the defendant in a positive light. They attempt to show that the defendant would be a low risk of future danger in a prison setting. They also focus on how bad his childhood was which effected his ability to make sound and rational decisions. They also try to convince the jury that violent behavior in society is not a good predictor of violent behavior in prison since they are different worlds.

Add to that the fact that Wyoming allows the defendants family to take the stand and plead for his life while it does not allow the victims family to take the stand and plead for justice. Victim impact statements are not allowed until the jury has decided on the Death Penelty, Life in Prison without Parole or simply Life in Prison. As many might know, the decision to impose the Death Penalty absolutely has to be unanimous. Very easy for at least one juror to hold out. I really believe the chances of all 12 returning with a decision to sentence to death is a long shot at best. Then at the end of the day, just before the defense rested, the defendant decided to excercise his right to take the stand and address the jury. I cant remember the legal term but the defendant can do this in the penalty phase, without being under oath and IS NOT SUBJECT TO CROSS EXAMINATION by the Prosecution.

Here is where things got interesting. Rolle took the stand and addressed the jury. In not so many words, he actually asked the jury to impose the Death Penalty. He advised he is a firm believer in the Death Penelty and that he deserves what he dealt out to my sister. He advised the jury he would be disappointed if they did not impose the harshest penelty allowed by the law. I was absolutely shocked since he has shown no emotion and absolutely no remorse during any phase of the legal process. I am wondering if he was sincere or if it was his last ultimate act of control. We will see what the jury does with it. Closing arguments for the penalty phase starts tomorrow and the case should go to the jury as early as noon. Hopefully by the end of tomorrow we will have some final closure to this nightmare.
 
Unfortunately, in a situation like this, there never can be a good outcome.

Jennifer is gone and nothing will bring her back.

Everything else is secondary.

The case was given to the jury in the penelty phase at about noon on 9-30-08. The Jury deliberated for about 3 hours and returned with their decision.

The Jury decided that Donald Lee Rolle would receive LIFE WITHOUT PAROLE for the first degree murder charge. He will likely also receive a second life term as well as 20 years for the kidnapping charge.

I am glad its over and my family can now have some closure. It wasnt the closure I hoped for but I respect the juries decision even if I dont agree. By and large some of the things that people hear about prison are falsehoods and urban legends. While it can be a rough place, acts of extreme violence and prison rapes are fairly rare. He will be classified as a medium security prisoner despite being a convicted murderer. He will get 16 hours a day outside his cell, be able to hold a job within the facility, have access to education, the library, internet and even cable TV. Three hot meals a day and a warm bed to sleep in. Not the life you or I would choose for ourselves but I can think of worse ways to live out my final days. True, he will never get out but he deserved what he dealt out.

While he may not have received the punishment that we have all hoped for, he will one day have to stand before the LORD and answer for his actions. GOD is the ultimate and final JUDGE and he will extract justice for your sister. God bless you and your family, I will continue to remember you in my prayers.

I believe too that his final judgement wont be one that he is so lucky with. Yesterday I got some information that made me feel a little better. When the Judge polled the jury they came back with a unanimous decision for Life Without Parole. In reality, that was not the case. The Jury Foreman came in and talked with the District Attorney after the trial. Come to find out the Jury did not understand the instructions provided and read in open court to them. They thought their decision had to be unanimous regardless of their decision. Only the death penalty sentence has to be unanimous. So the truth is, 10 jurers voted for the death penalty and only two abstained and voted for life without parole. Once that happens its done but it still made me feel better that at least 10 of the 12 felt he needed to pay the ultimate price.
 
He has more luxuries than he deserves in there, that is for sure! But next time your out hunting or you have a day when you look around and just smile because its such a nice day........remember you sister is enjoying it to, and that scumbag is in the can for good!!!!

I can't imagine having to deal with such a circumstance and would find it very hard to controll my anger. You have my prayers and best wishes, and I hope that he gets the worst possible punishment for his crime. I am afraid that even that won't do justice...
