I JUST held a conversation with ATF about shifting a can or two to a trust that are on approved paper form 4 to me as a individual.
So If I desired I could leave with my son, daughter in law, hunting buddy if I desired.
At one point we as individuals was sort of barred from eform 4 submittal. Glad to say that has been fixed. At one point the guidance was that they had to be done on paper form 4's if doing a transfer from individual to trust. I was gladly informed when they overhauled Eforms for the new laws they fixed this, and now we can submit via Eforms.
This revision wasn't in a new law just a change in the procedures for eforms.
But here is the confusing part or at least for the eforms system. The accounts, versus using just one account to transfer say my existing can to the trust. They advised setting up another account for just the trust. in reality kind of makes sense one account for me (individual), one for the trust. Although a vast majority of the information would be the same.
Makes sense if using just one account it wouldn't be a actual transfer. So what would happen I would use the individual account to transfer the item to the trust account in eforms.
Think of it as a bank account, shifting money from an account that only you have access. To a joint account that other have access is about the best way I can describe it. What was advised made perfect sense once I thought of it in that manner.
Primarily to me the trust has a advantage for:
a. Leaving with a trustee for usage /storage without me being present. Provided there is not a law prohibiting possession by that person / location.
b. Individuals that could be / or are subject to temporary re-location. i.e Military, other Government employee, or a business that has overseas employment opportunities in a state that prohibits the possession of a suppressor / NFA items. In the event of overseas it's the re-importation of the item is what get one.
That way the item can be stored /used without question offsite. There has been provisions in the past that allowed for storage of a NFA Items with several criteria's to be met. The main was the access (stored in a safe with just the approved person having access), the trust loosens this part.
Trust has the ability to be modified depending on type and the state the trust resides in. So yes you can add or remove persons / trustees after the approval status.
While typing the above I received a call from my LGS the new can is approved today. (submitted on the 01/07/2026 approved 1/20/2026). Just picked it up. woohoo.
FYI the stamp is blue in color and with a zero dollar denomination on my form.
