Can anyone explain to me the benefit of setting up an NFA Trust? Based on the bullet points that I've read, it seems like a good thing, but I don't know that I understand the actual benefit.
 
Widow Maker, based what you are saying that means that I can place my sons on the trust and they can take possession of what is in the trust if and when I pass? Do they need to be screened and background checked by the ATF?
 
Basically Yes, All members on the trust need to go through the process. Read through this it will help clarify. Its more footwork in the beginning but having it so anyone on it can use it will be nice. I dont have one but looked into in once.

I JUST held a conversation with ATF about shifting a can or two to a trust that are on approved paper form 4 to me as a individual.
So If I desired I could leave with my son, daughter in law, hunting buddy if I desired.

At one point we as individuals was sort of barred from eform 4 submittal. Glad to say that has been fixed. At one point the guidance was that they had to be done on paper form 4's if doing a transfer from individual to trust. I was gladly informed when they overhauled Eforms for the new laws they fixed this, and now we can submit via Eforms.
This revision wasn't in a new law just a change in the procedures for eforms.

But here is the confusing part or at least for the eforms system. The accounts, versus using just one account to transfer say my existing can to the trust. They advised setting up another account for just the trust. in reality kind of makes sense one account for me (individual), one for the trust. Although a vast majority of the information would be the same.
Makes sense if using just one account it wouldn't be a actual transfer. So what would happen I would use the individual account to transfer the item to the trust account in eforms.
Think of it as a bank account, shifting money from an account that only you have access. To a joint account that other have access is about the best way I can describe it. What was advised made perfect sense once I thought of it in that manner.

Primarily to me the trust has a advantage for:
a. Leaving with a trustee for usage /storage without me being present. Provided there is not a law prohibiting possession by that person / location.
b. Individuals that could be / or are subject to temporary re-location. i.e Military, other Government employee, or a business that has overseas employment opportunities in a state that prohibits the possession of a suppressor / NFA items. In the event of overseas it's the re-importation of the item is what get one.

That way the item can be stored /used without question offsite. There has been provisions in the past that allowed for storage of a NFA Items with several criteria's to be met. The main was the access (stored in a safe with just the approved person having access), the trust loosens this part.

Trust has the ability to be modified depending on type and the state the trust resides in. So yes you can add or remove persons / trustees after the approval status.

While typing the above I received a call from my LGS the new can is approved today. (submitted on the 01/07/2026 approved 1/20/2026). Just picked it up. woohoo.
FYI the stamp is blue in color and with a zero dollar denomination on my form.

Sweet Mike, glad you got approved and delivery! I just ordered two today, so we'll see what happens in that regard.
After ordering I saw their, Capitol Armory, little speal about setting up a trust. I'm probably going to do it, but I'll look into a little bit longer. Thanks for taking the hit for the rest of us and talking to those guys.

I do have sort of funny story to tell on when I picked up the OCL Titanium .22 suppressor. When I went to buy the suppressor I was going to go with the Silencerco Sparrow for this purchase. Out of stock sold out so I looked in the case for a "better" can well the OCL titanium was there, which was on my list to buy . Fast ward to pick-up day I was talking to another customer whom was picking up his (Sparrow) in the conversation he said yeah I bought the last one. I looked at him and said " YOU!...individual" with a grin on my face, I was laughing you bought it just before I came in to get it. He and I laughed a bit, and I relayed that honestly the one I got in stead of the sparrow was on my list just was going to get it after the sparrow. So he and I wound up cutting up a bit, wishing each other well as we departed.
