Ten-Ring Precision, Inc.
of San Antonio Files Lawsuit in Federal Court
On Friday, August 5th, Alex Hamilton of San Antonio-based Ten-Ring Precision, Inc. became the plaintiff in a lawsuit naming Kenneth Melson, Acting Director, Bureau Alcohol, Tobacco, Firearms, and Explosives of Washington, D.C. as the defendant. The suit was filed in Federal District Court, the Western District of Texas. The first major concern is a request by the agency for a change of venue.
The purpose of the suit is to secure the right of licensed firearm dealers (FFLs) NOT to submit to a rule change requiring reports and information with respect to records FFLs are required to maintain; and specifically not to submit a report on the sale or disposition of two or more semi-automatic rifles of greater than .22 caliber, capable of accepting a detachable magazine, and transacted within five business days. All of this applies only to states bordering Mexico.

The suit challenges BATF's broadening of existing federal law requiring an FFL to report the model, serial number, type, and caliber of two or more handguns when sold within five business days.
The reporting of long gun transactions is expressly NOT required by law.
Only states bordering with Mexico are included in the regulation which serves no law enforcement applications beyond being an unfunded mandate with a chilling effect on gun ownership. Congress has not appropriated additional funds to sort, store, or follow up on the new requirement.
