But then again, maybe the ATF thinks that anybody buying a gun with the INTENT to re-sell needs a Federal Firearms License.
Finding a 4473 filled out and signed at Wally World on a specific gun, and then finding that gun for sale the same day unfired and new-in-the-box on an internet forum might give them a reason to suspect intent. And it would also give them all the evidence they needed to prosecute the case.

The ATF also has little tolerance for "straw purchases", even for people who are not prohibited from buying the firearm for themselves.
